Appellees, as dependents of the decedent employee Zimmerman, filed application for compensation under the Workmen's Compensation
Act (Burns' Ann. Stat. Sec. 40-1201 et seq.) growing out of his death while diving into the lake at the lakeside summer home
of his employers after the Conclusion of a business meeting had at such summer residence. The Industrial Board granted an
award of compensation which was reversed by a divided Appellate Court, the majority opinion appearing in 137 N.E.2d 233, and
the Dissenting opinion at page 240. The case is now before us on appellees' petition to transfer. Appellants assert on this appeal that the award was contrary to law as there was no basis in the evidence to support the
finding that decedent was injured and thereafter died from an accident arising out of and in the course of his employment.
